COMEDK UGET 2013: Notification regarding Surrender of Engineering Seats

The COMEDK authorities have issued a notification regarding the surrender of seats to the engineering courses. The notification mentions that the last date for surrender of seats was scheduled as July 17 on account of the second round of counselling that was held from July 19 to 24, 2013.

Surrender during and after the second round of counselling was not allowed as there was no third round of counselling on account of the Hon’ble Supreme Court directions in the case of Ms. Neelu Arora M.S. and Another Vs. UOI and other [(2003) 3 SCC 366]. Therefore students who have not surrendered seats by the said date  were expected to report to the allotted colleges.

However, on account of the State Karnataka Examination Authority (KEA) conducting more than two rounds of counselling, students who have been allotted seats  through the KEA would prefer them on account of low fees. The colleges affiliated to the COMEDK also have a seat sharing arrangement with the KEA.

Considering these circumstances, the COMEDK authorities have requested the colleges concerned to accept the surrender of any student subject to their management policy. They further mention that a portion of the fee deposited by the students to COMEDK (Rs 50,000) will be transferred to the respective colleges within the next 10 days. Therefore the colleges may consider an appropriate refund of the tuition fee of the candidates who wish to surrender their seats.

Seat filling of such surrendered seats can be as per the Hon’ble Supreme Court judgment in CIVIL APPEAL NO. 9048 OF 2012 (Arising out of SLP (C) No. 26086 of 2012) between Parshavanath Charitable Trust & Ors. Vs. AICTE & Ors.
